Welcome to MyWorkEase, a software-as-a-service (SaaS) platform developed and managed by 24thCentury Intelligence Pvt. Ltd. (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the MyWorkEase platform (“Platform” or “Service”). By accessing or using the Platform, you (“User”, “you”, or “your”) agree to comply with and be bound by these Terms.

If you do not agree with these Terms, you may not use the Platform.

1. Definitions

1.1 Platform: Refers to MyWorkEase, including all associated software, features, updates, and content provided by the Company for managing Objectives and Key Results (OKRs).

1.2 User: Refers to any individual or organization accessing or using the Platform.

1.3 Content: Includes all data, information, text, graphics, or materials uploaded, posted, or transmitted via the Platform by Users.

2. Eligibility

2.1 By using the Platform, you represent and warrant that you are at least 18 years of age and have the authority to enter into and bind your organization to these Terms.

2.2 If you are using the Platform on behalf of an organization, you agree to these Terms on behalf of that organization and affirm that you have the legal authority to do so.

3. User Accounts

3.1 Registration: To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Notify us immediately of any unauthorized access or use of your account.

3.3 Account Termination: The Company reserves the right to suspend or terminate your account if you violate these Terms or if your use of the Platform disrupts or poses a risk to other Users.

4. Use of the Platform

4.1 License: Subject to your compliance with these Terms, the Company grants you a non-exclusive, non-transferable, revocable license to access and use the Platform for your organization’s internal business purposes.

4.2 Prohibited Activities: You agree not to:

  • Use the Platform for any unlawful purpose.

  • Reverse engineer, decompile, or disassemble the Platform.

  • Distribute malware, viruses, or harmful content.

  • Access or attempt to access the accounts of other Users without authorization.

  • Misuse the Platform to upload, store, or share inappropriate, offensive, or unauthorized content.

4.3 Third-Party Services: The Platform may integrate with third-party services. Your use of such services is subject to their respective terms and conditions.

5. Fees and Payment

5.1 Subscription Plans: Access to the Platform may require payment under a subscription plan. Subscription details, including pricing and payment terms, are available during the sign-up process.

5.2 Billing: You authorize the Company to charge your provided payment method for all applicable fees.

5.3 Refunds: Fees are non-refundable except as required by law or explicitly stated in our refund policy.

5.4 Late Payments: Failure to pay on time may result in suspension or termination of your access to the Platform.

6. Intellectual Property

6.1 Ownership: The Company retains all rights, title, and interest in the Platform, including all related intellectual property. These Terms do not grant you any ownership rights in the Platform.

6.2 User Content: You retain ownership of all content you upload to the Platform. By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for operating and improving the Platform.

7. Confidentiality

7.1 You agree to maintain the confidentiality of any non-public information related to the Company, the Platform, or other Users, except as required by law.

8. Data Privacy

8.1 Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

9. Disclaimer of Warranties

9.1 The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. The Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

10.1 To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

10.2 The Company’s total liability for any claim under these Terms shall not exceed the amount you paid for the Platform in the 12 months preceding the event giving rise to the claim.

11. Indemnification

11.1 You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, or losses arising from your use of the Platform or breach of these Terms.

12. Termination

12.1 The Company may suspend or terminate your access to the Platform at any time, with or without cause, upon notice.

12.2 Upon termination, your right to use the Platform ceases, but Sections 6, 7, 9, 10, and 11 of these Terms shall survive.

13. Governing Law and Dispute Resolution

13.1 These Terms are governed by and construed in accordance with the laws of India.

13.2 Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

14. Amendments

14.1 The Company reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. Continued use of the Platform constitutes your acceptance of the revised Terms.
